Terms And Conditions
1. Definitions
In this document, the following terms shall have the following meanings:
1.1 "Doge Tune" refers to the company providing the products and services covered by this agreement.
1.2 "Product" refers to any hardware sold by Doge Tune, excluding any Software.
1.3 "Software" refers to any software provided by Doge Tune
1.4 "Original Purchaser" means any consumer who purchases and has possession of a Product directly from Doge Tune.
1.5 "End User" refers to the consumer of the Product, which includes anyone who owns and uses a Doge Tune Product.
1.6 "Date of Original Retail Purchase" means the date the Original Purchaser bought the Product from Doge Tune.
2. Acceptance
This agreement is made between Doge Tune and the Original Purchaser. Unless otherwise agreed in writing, these conditions shall be the only ones applying to any contract for the supply of goods and services by Doge Tune. No substitution for these Terms and Conditions shall be binding on Doge Tune.
3. Prices
All prices are subject to revision without notice, unless otherwise stated by Doge Tune in writing. Prices charged would be those prevailing at the date of dispatch. All prices quoted include GST.
4. Software License
Any Software provided by Doge Tune is released under the GNU-GPL V3 general public license, and is provided without any warranty whatsoever. Doge Tune shall not be liable for any damages or losses of any kind arising from the use of the Software, including but not limited to direct, indirect, incidental, punitive, special or consequential damages.
5. Legality of Products
All Products sold by Doge Tune are, to the best of its knowledge, legal and not controlled items or services in any jurisdiction, including Singapore. End Users are responsible for ensuring compliance with local laws, rules and regulations governing the use of Doge Tune's Products. Doge Tune shall not be liable for any legal, punitive, or special consequences resulting from the illegal use of its Products.
6. Compliance with Singapore Laws and Regulations
6.1 All Products, including batteries, chargers, and other applicable items sold by Doge Tune, are not compliant with EN15194, UL2272, or Land Transport Authority (LTA) regulations in Singapore. By purchasing any of our Products or services, the End User agrees not to:
6.1.1 Use our Products to operate Personal Mobility Devices (PMDs), Power-Assisted Bicycles (PABs), or any other active mobility devices on public paths or roads in Singapore.
6.1.2 Use or involve our Products to illegally modify PMDs, PABs, or any other active mobility devices.
6.1.3 Use or involve our Products in any dangerous manner that endangers the lives of the End User or others.
6.1.4 Use or involve our Products in any manner that is in violation of LTA's rules and regulations.
6.2 The End User accepts the above terms and conditions and acknowledges that all Products (where applicable) are intended for export purposes, usage on private property or land, and should never be used with a PMD, PAB, or any other active mobility device under any circumstances on public paths or roads in Singapore.
6.3 In the event that the End User disregards the above terms, conditions, and guidelines, the following consequences will apply:
6.3.1 The End User alone will bear the full legal consequences and any other repercussions resulting from the illegal usage of our Products.
6.3.2 Doge Tune will not be held liable and will not be responsible for any legal, punitive, or special consequences resulting from the End User's illegal usage of our Products.
6.4 In general, using our batteries or Products for purposes or applications that require a standalone power source (e.g., in a backup/portable power supply system, lighting, DC pump) is legal. However, installing them on a PMD, PAB, or any other active mobility device to be ridden on public paths or roads in Singapore is not permitted.
6.5 End Users are responsible for understanding and adhering to all applicable laws, rules, and regulations governing the use of the Products in Singapore, including but not limited to the Active Mobility Act, the Road Traffic Act, and any other relevant statutes, regulations, or guidelines issued by the LTA or other relevant authorities.
7. Warranty
Doge Tune warrants the Original Purchaser that any part of the Product will be free of defects in workmanship and materials for the warranty period specified at the time of purchase. The warranty period commences on the date of collection or delivery of the Product. During the warranty period, Doge Tune will repair or replace, at its discretion, defective hardware free of charge. Replacement parts may not be identical but will be comparable in quality. Additional charges may apply under certain conditions, as specified in the terms below.
8. Warranty Exclusions
Doge Tune's warranty does not cover any defects, malfunctions or damages caused by regular wear and tear, accident, abuse, misuse, misapplication, natural causes, environmental conditions, improper modification or disassembly, improper handling, improper charging or use with a faulty or mismatched charger, or electrical damage caused by dead shorts, polarity confusion, or over-discharge. Doge Tune reserves the right to refuse service or void the warranty under certain conditions, as specified in the terms below.
9. Warranty Forfeiture
Doge Tune reserves the right to forfeit the warranty of any Product under certain conditions, including but not limited to the following:
9.1 Non-compliance with the terms outlined in this agreement.
9.2 Legitimate reasons to believe that the End User has an ulterior motive other than making a legitimate warranty claim.
9.3 Abuse, defamation, blackmail, or threats to the personal safety of Doge Tune's personnel by the End User.
9.4 Legitimate reasons to believe that the End User is lying in an attempt to expedite the warranty process or to commit fraud.
9.5 End User's failure to provide legitimate identification, such as an order ID, phone number, username, email address, or receipt to prove purchase of the Product.
9.6 The product brought in for warranty does not match the description of the product sold (i.e., attempted warranty fraud).
9.7 Knowledge that the End User has involved the Product in any form of illegal activity under their local laws or regulations.
10. Warranty Service Guidelines
If the End User encounters any issues with the Product while adhering to the terms outlined in this agreement, they may return the Product to Doge Tune within the specified warranty period for service, repair, or exchange free of charge. Downtime during the warranty service process may last from a few days to several weeks or months. Doge Tune is not responsible for, and will not compensate for, any loss of income, transportation charges, or any other expenses incurred during the downtime of the Product and the resolution process.
11. Limitation of Liability
In no event shall Doge Tune, its directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from the legal or illegal use of any of the Products or services provided by Doge Tune, or for any other claim related in any way to the use of the Products or services, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Products or services, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states or jurisdictions, Doge Tune's liability shall be limited to the maximum extent permitted by law.
